My client wants to hold an auction to sell her house. Since I’m a licensed real estate agent, can I call the auction?
No. You must be licensed as an auctioneer by the Texas Department of Licensing and Regulation to call an auction. Your real estate license alone doesn't authorize you to act as an auctioneer.
This brings up a question. A property hit the market on a Tuesday, I had the listing agent a near full tilt cash offer with no third party service contracts and choice of seller picking the closing date they wanted by 3:00 P.M. the same day. The listing agent notified me they were taking bids until 5 p.m. on Thursday two days later. I handled it by putting a deadline of midnight the same day I submitted it, and the seller accepted our offer. That’s a really good question? I’ve never thought about putting a time line on accepting offers as a sort of auction….Could someone with authority please respond now that this question has been raised?
I’m not an attorney… but am an Auctioneer and Real Estate Broker, although I can only wear one hat at a time, never both. In either world, the seller is in charge. In your case, apparently it became obvious quickly that there would be multiple offers, so setting a deadline for offer submission was at the direction of the seller, with a date/time certain, basically a sealed bid opening, with bid opening at that date/time certain.
